1. "AS IS" Software Delivery & No Liability

All custom Python scripts, bots, and automated tools (collectively referred to as "the Software") are developed, delivered, and sold strictly on an "AS IS" and "AS AVAILABLE" basis. The Developer makes no guarantees, warranties, or representations of any kind regarding the long-term functionality, stability, or uptime of the Software. Websites frequently update their user interfaces, source code, and security measures. The Developer is not responsible or liable if a target website modifies its platform in a way that renders the Software non-functional at any point after the transfer of ownership.

2. Complete Transfer of Responsibility & Ownership

Upon final payment and the successful transfer of the private GitHub repository ownership to the Buyer, the Buyer assumes 100% full legal and operational responsibility for the Software, its deployment, and its maintenance. The Developer retains no control, access, or oversight regarding how, where, or against which targets the Buyer runs the Software. The Developer shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use, misuse, or inability to use the Software.

3. Compliance with Local and International Laws

The Software is developed and sold strictly for legitimate Open Source Intelligence (OSINT) research, cybersecurity auditing, administrative automation, and educational purposes. The Buyer certifies that they will comply with all applicable local, national, and international laws, including but not limited to the UK Computer Misuse Act 1990, the UK Data Protection Act 2018 / UK GDPR, and relevant copyright or database right regulations. The Buyer agrees never to use the Software to engage in unauthorised access, Distributed Denial of Service (DDoS) attacks, data harvesting of private individuals without legal basis, or any activity that violates cyber-security legislation.

4. Platform Terms of Service (ToS)

Automated data collection may violate the specific Terms of Service (ToS) or Terms of Use of the target website(s). The Buyer acknowledges that running automated scripts, bots, or scrapers against any target platform carries an inherent risk of account suspension, IP banning, or legal action from the target platform operators. The Buyer accepts full responsibility for reviewing the target website’s robots.txt files and Terms of Service, and agrees to indemnify and hold harmless the Developer against any claims, losses, or legal disputes arising from a breach of a third-party platform's terms.

5. Governing Law

These Terms of Sale and Disclaimers are governed by and construed in accordance with the laws of England and Wales. By submitting a deposit or completing a purchase, the Buyer explicitly agrees to these terms in full.

6. Active Maintenance & Support Clause

If the Buyer subscribes to an optional maintenance plan, retainer, or update package, the Developer's access to the software repository is strictly limited to code optimization, structural updates, and layout-patching to restore baseline functionality. The Developer does not monitor, review, or assume any liability for the data inputs, operational targets, or specific use-cases executed by the Buyer during or after any maintenance period. The Developer reserves the right to immediately terminate maintenance services and sever repository access without a refund if the Software is found to be used in violation of Section 3 of this agreement.
